Petition Submission
The first step in the process is to file a petition. This petition is submitted on the behalf of the family member by a U.S. citizen or permanent resident. The petitioner must file Form I-130 with the United States Citizenship and Immigration Services (USCIS). You can apply through the internet. You can also send your form through physical mail. U.S. employers file form I-140 by following the instructions of USCIS.
Case Preparation
After you get the approval of USCIS which is received by the National Visa Center (NVC). NVC further process the application. NVC will send all the details related to the application to the petitioner. First, you need to prepare your case. you need to submit your required documents and processing fees for immigration. You need to prepare affidavits of financial support, civil documents, and other necessary documents. You need to send all your documents to schedule your interview. The U.S. decides the quota for immigration each year. USCIS approval doesn’t mean you’ll get your U.S. visa immediately. You can see the priority dates on the visa bulletin page. Priority date refers to the date you submit your petition. You can also check if a visa is offered for your petition or not from the visa bulletin. You need to respond to NVC within a year of petition or else they can dismiss your petition.
After you submit all your documents to National Visa Center. They further process it and play their part in your application process. After processing it, they send a letter to the petitioner with a date and time for the interview. They also provide all the instructions that you need to follow in the letter. You need to prepare all the documents according to the instructions for the interview.
After scheduling the interview, you need to do a full medical examination from an authorized doctor. You need to do this exam with Embassy approved doctor. You need to complete your medical examination and get mandatory vaccination. Sometimes physicians directly send the test results to the Embassy or give a sealed envelope to you after the medical examination. You are not allowed to open that envelope. You need to bring that sealed envelope to the interview. If you do open the envelope then you need to do the medical examination again.
You need to go to the embassy or consular office on the set date for your visa interview. You have to bring all the necessary documents, medical examination results, and a printed confirmation page of the visa application. You will be interviewed by a consular officer. He will decide if you are suitable or not for immigration. All the family members (spouse, minor children, or parents) that are immigrating with you need to appear on the day of the interview. If your immigration date is different from other members then they don’t need to come on your interview day. Their interview will be scheduled for some other date. Following documents are necessary for the interview:
- Appointment Letter
- Photographs
- Passport
- Confirmation Page of Visa Application (DS-260)
- Supporting Documents
After the interview, you will get to know if your visa application is accepted or rejected. If it is accepted then you will get your passport back almost in 10 days. your visa will be on your passport’s page. You need to check all the information, if there is any mistake then you need to immediately call the embassy or consular office. You need to pay your fee to the United States Citizenship and Immigration Services. Otherwise, they won’t give a green card (I-551or I-151). Before your passport expires, you need to reach in and request admission to the U.S. if you are the primary applicant then you need to enter before the other family members or you can enter at the same time. Homeland Security, U.S. Customs and Border Protection department (CBP) can permit you to enter. Getting a U.S. visa doesn’t give the surety that you can enter the United States. CPB can deny admission if you don’t fulfill their requirements. If your visa is rejected, you will get to know through the consular official. They will tell you why you are not eligible for a U.S. Visa. Based on U.S. law, not every person who applies for a visa is also qualified. There is a set criterion that you need to fulfill to get a U.S. visa. You can file for a waiver in some cases. if you do so, a consular official will guide you on what you need to do. Sometimes it will take time to get your green card on your U.S. address. In that case, you can travel with a CBP stamp and your immigrant visa. You can use these documents for traveling for a year from your first entry date. Make sure, to tell the truth, and submit authentic documents throughout the visa process. Or else it will take the time or in extreme situations, your application can be dismissed.
